Telefónica reiterates opposition to Telecom-Cablevisión merger


Telefónica again appeared before Argentina’s Ministry of Commerce questioning the approval of the merger between Telecom and Cablevisión.
According to iProfesional, if the company does not receive the authorities’ response, it will go to the Civil and Commercial Justice, and would be willing to go to the ICSID (International Centre for Settlement of Investment Disputes).
On July 24, Telefónica had challenged the approval of the merger and denounced “discriminatory treatment for the rest of the operators”. The company also considered that the decision “puts obstacles to the development of effective competition in the telecommunications market and favors a dominant operator in the sector “.
However, after waiting for the corresponding time, the company did not receive a response from the authorities and decided to present a new complaint. In parallel, Telefónica submitted notes to both the Ministry of Production and Modernization.
iProfesional reported that telecommunications company Claro (América Móvil) also presented a formal complaint against the approval of the merger.
The National Commission for the Defense of Competition (CNDC), an entity that reports to the Ministry of Commerce, approved, with conditions, the merger between Cablevisión, the country’s main pay TV operator, and Telecom on June 29.
